Terms & Conditions – Brazilian Brothers Kitesurfing Clinics
1. General Scope
These Terms & Conditions (“Terms”) govern every kiteboarding, wing-foiling, surfing, stand-up paddling, or related activity (“Retreat” or “Activity”) offered by Brazilian Brothers Kitesurfing (“Brazilian Brothers,” “we,” “our,” or “us”) to any participant (“Guest,” “you,” or “your”). By registering for a Retreat, you acknowledge that kite and water sports carry inherent risks and agree to comply with all safety instructions, local laws, and regulations. We strongly recommend the use of personal protective equipment (impact vest, helmet, flotation aid, etc.). Choosing to forego such equipment is entirely at your own risk.
2. Registration & Acceptance
- How to book. Reservations may be made through our website, by e-mail, telephone, or approved messaging platforms.
- Binding agreement. Completing the online checkout, signing any digital or hard-copy registration form, or forwarding written confirmation constitutes full acceptance of these Terms by you (and, where applicable, by your parent or legal guardian).
- Age. Guests must be 18 years or older. Minors (12–17 years) may attend only with the written consent of a parent or legal guardian who must also sign these Terms on the minor’s behalf.
3. Payments
- A 50% deposit of the total clinic price is due at the time of booking.
- The remaining balance must be received no later than 30 days before the start of the clinic.
- Late payments may result in automatic cancellation and forfeiture of paid amounts (see §4).
4. Cancellations by Guest

Re-sale Clause: If you cancel, we will attempt to re-sell your spot after all unsold spaces for the clinic have been filled. If we are successful in selling your original spot, you will receive a full refund, regardless of the cancellation timeframe above.
All cancellation requests must be submitted in writing (email suffices). Refunds, where applicable, are processed within 30 business days to the original payment method.
5. Date or Package Changes
- One change of Retreat date may be requested up to 60 days prior to check-in, subject to availability and confirmation in writing from Brazilian Brothers.
- Any payments already made will remain on credit for up to one (1) year from the date of the change request and may be applied to any Retreat of equal or greater value.
- Subsequent changes or requests inside 60 days are treated as a cancellation (§ 4).
6. Accommodation & Catering
Unless explicitly included in the Retreat description, lodging and meals are supplied by independent third-party providers. We facilitate the reservation but assume no liability for the acts or omissions of these providers. Any issues arising from accommodation or catering must be addressed directly with the provider.
7. Lodging Rules at Vilas Siará
Guests staying at Vilas Siará, our partnered beachfront accommodation, agree to the following house rules during their stay:
A. Behavior & Conduct
- Guests must maintain respectful conduct toward staff, neighbors, and other guests.
- Hosting parties, events, or gatherings that exceed the authorized occupancy of the villa is strictly prohibited, unless expressly approved in writing beforehand.
- The use of illegal substances is forbidden on the property.
B. Quiet Hours
- Quiet hours are from 10:00 PM to 8:00 AM, with no exceptions.
- Portable speakers, Bluetooth sound systems, and musical instruments must be used at moderate volume and with consideration for neighbors.
- Excessive noise resulting in formal complaints may result in penalties or early termination of the stay without refund.
C. Property Damage & Use of Items
- Guests are responsible for any damage to the property, furniture, appliances, or equipment in the villa.
- Damaged, stained, or broken items will be charged based on replacement or repair estimates.
- Towels, linens, and other fabrics used outside their intended purpose (e.g., at the beach, as cleaning cloths) may incur replacement charges.
D. Cleanliness
- Guests are expected to maintain basic tidiness during their stay.
- An additional cleaning fee may apply if the villa is returned in a condition deemed excessively dirty.
- Brazilian Brothers and Vilas Siará reserve the right to refuse future bookings for egregious cases of disregard.
E. Access & Safety
- Unauthorized visitors are not allowed on the premises.
- Guests are fully responsible for their belongings.
- Doors and windows must be locked whenever leaving the property.
F. Check-In & Check-Out
- Check-in is from 3:00 PM, and check-out is by 12:00 PM, unless otherwise agreed.
- Late check-out may incur additional charges.
G. Breach of Rules
Failure to comply with the above may result in:
- Application of contractual penalties
- Immediate termination of the stay without refund
- Refusal of future lodging reservations
8. Weather Contingencies
Kiteboarding depends on wind and sea conditions. If unsuitable weather prevents on-water sessions, Brazilian Brothers will arrange alternative coaching (e.g., video analysis, theory classes, beach drills, foil sessions, cultural excursions). No refunds or price adjustments are granted for lost wind time.
9. Safety, Health & Conduct
- You affirm that you are physically fit to partake in vigorous water sports.
- Any medical conditions, allergies, or injuries that may impair your safety—or that of others—must be disclosed to us in advance.
- The consumption of alcohol, recreational drugs, or impairing medications during activity hours is prohibited.
- Our coaches may suspend or expel a guest for dangerous behaviour, inadequate skill level, or failure to follow instructions, without refund.
10. Insurance Requirement
Prior to arrival you must hold travel insurance that expressly covers kiteboarding and watersports, including medical evacuation and equipment liability.
11. Assumption of Risk & Liability Release
Assumption of Risk & Release of Liability By participating in any Retreat or related activity, you acknowledge and voluntarily accept the inherent risks involved in kiteboarding, surfing, foiling, and other water or land-based sports—including but not limited to physical injury, property damage, or death—whether those risks are known or unknown at the time of participation. You agree that BrazilianBrothers Kitesurfing, its owners, instructors, employees, affiliates, contractors, sponsors, and partners (“Released Parties”) shall not be held liable for any loss, injury, death, damage to personal property, or third-party claims arising directly or indirectly from your participation, even if caused in whole or in part by the ordinary negligence of a Released Party. You further agree not to initiate legal action against the Released Parties and to fully indemnify and hold them harmless from any claims, damages, losses, or legal costs—including attorney’s fees—that result from your own conduct during the Retreat. This release does not waive liability for gross negligence, recklessness, or intentional misconduct where such waivers are prohibited by law.
12. Damage to Equipment
You are financially responsible for the kite, board, bar, harness, radio, or other gear provided to you. Repair or replacement costs for loss or damage beyond normal wear will be charged to you on-site.
13. Media & Personal Data Consent
By attending a Retreat you grant Brazilian Brothers the perpetual right to use photographs, audio, or video in which you appear, for marketing or educational purposes, without compensation. Personal data collected during booking is processed in accordance with Brazilian data-protection law (Lei Geral de Proteção de Dados – LGPD) and is never sold to unrelated third parties.
14. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Federative Republic of Brazil. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts located in Jijoca de Jericoacoara, State of Ceará, Brazil. The Participant expressly waives any right to claim that such forum is inconvenient or improper.
15. Amendments
We may revise these Terms at any time. The version in force on the date you book will remain applicable to that booking unless mutually agreed otherwise in writing.
16. Severability
If a court finds any provision unenforceable, the remainder shall remain valid to the maximum extent permitted by law.
17. Entire Agreement
These Terms, together with any signed waivers or booking confirmations, form the entire agreement between you and Brazilian Brothers regarding the clinic and supersede all prior understandings. Where multiple documents exist, the one providing the broadest release of liability shall prevail.
